You’ve presumably heard that Matt Gaetz has taken himself out of consideration for Attorney General. This is likely bc paying for sex with anyone of any age is illegal in FL. If the person is a minor it’s considered sex trafficking to boot and there’s a whole lot of sworn testimony that he did that. So now what? Gaetz was just re-elected to FL’s first district. While his resignation letter said he did not “intend” to take his seat, he still can. +

Or, perhaps Gov. DeSantis will appoint Gaetz to finish Rubio’s term. The Senate Ethics Committee exists only on paper, so that would be good for Gaetz. If Gaetz does take his seat for the 119th Congress, the Ethics case for him cd continue, although it probably wouldn’t. To carry it over to the new Congress, a majority of the committee wd have to agree. If the Republicans wouldn’t release the report, they’re unlikely to vote to keep investigating. +

Or, Trump might try to find Gaetz a position in the administration that doesn’t require Senate confirmation. Basically, don’t assume he’s done in government. / end

@GovTrack Rs may need him plus waltz and stefanik for a clean Speaker vote. They have to not only have more votes than Ds but also the fringe Rs who could vote for anything or anyone

@louis He resigned from the 118th Congress which continues until January 3, 2025. In the election just 2 weeks ago, he was re-elected for the _119th_ Congress which starts on Jan. 3, 2025. His resignation letter said he did not “intend” to take his seat, but I haven’t seen any confirmation on whether that’s binding or whether he can just show up. I mean, he was elected by a substantial margin. So ¯\_(ツ)_/¯

The (US) constitution says that each house of congress shall be the sole judge of its members' qualifications. By historical precedent (Victor Berger) it takes merely a majority of the House to deny an elected member his/her seat. Contrast this with expulsion of a seated member, which requires a two-thirds supermajority.

@artemesia exclusion is harder than it seems. Adam Clayton Powell was excluded in 1969 and later the Supreme Court vacated the exclusion. https://www.govtrack.us/misconduct Plus, a majority might not want to exclude him.

@VirginiaHolloway @PizzaDemon He resigned from _this Congress_. The 118th. He said in his resignation letter that he did not “intend” to take the seat he won two weeks ago for the _119th Congress_. What’s unclear is how binding that phrasing is. Not sure these exact circumstances have arisen before.
